Terms & Conditions.
1. Introduction
1.1 These terms and conditions shall govern the sale and purchase of products through our website, our markets and orders taken via social media platforms (Facebook & Instagram).
1.2 You will be asked to give your express agreement to these terms and conditions before you place an order through social media or our website.
1.3 This document does not affect any statutory rights you may have as a consumer (such as rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015).
2. Interpretation
2.1 In these terms and conditions:
(a) "we" means B’s Cakes & Bakes and
(b) "you" means our customer,
and "us", "our" and "your" should be interpreted accordingly.
3. Allergens
3.1 It is your responsibility as the customer to alert us of any allergies or dietary requirements before payment is made.
3.2 Even if you alert us of an allergy, we will not be held responsible if you take the risk to order from us.
3.3 On a daily basis we work with:
a) Gluten
b) Egg
c) Milk
d) Nuts
e) Soya
f) and other allergens.
4. Personalised celebration cakes
4.1 When you would like to purchase a personalised cake from us, it is a requirement that we receive a 50% deposit of your total order price. This deposit is non-refundable.
4.2 Orders will not be confirmed until the receipt of your deposit.
4.3 Completion of the purchase is whereby you pay the remainder 50% withstanding on your cake order. This is due on the day before by bank transfer unless otherwise agreed.
4.4 Delivery of cakes or any other goods will incur an additional charge. We will attempt a delivery once, at a time arranged between us. If you are not in, we will take the cake back to our premises and it will be your duty to collect it or pay the delivery fee again for us to return.
4.5 If you have paid your deposit and do not collect your cake when it has already been made, we are under no obligation to return the deposit as it has been deemed non-refundable (see 4.1) and it will be kept to recover the costs we have incurred.
4.6 You may choose to pay upfront in full at your discretion.
4.7 All quotations sent to you will be valid for 14 days, after this I reserve the right to revise the quote and issue a new one, amending the price where I see fit.
4.8 The prices stated on our page are starting prices only, decorations will incur an additional cost.
4.9 We will assume you will be collecting your cake from our premises in Pudsey, Leeds unless you specify otherwise.
5. Wedding Cakes
5.1 We require at least a months notice for wedding cakes.
5.2 If a tiered wedding cake is ordered with 2 weeks notice, a late charge of £50 will be added to the quote.
5.3 If a tiered wedding cake is ordered with a weeks notice, a rush charge of £100 will be added to the quote.
5.4 To secure your booking, there must be £75 non-refundable deposit paid. The date and the order with neither be confirmed until receipt of this deposit.
5.5 You may choose to pay in full, or in instalments. This is at your discretion as the customer.
5.6 All quotes sent to you for wedding cakes are valid for 2 months, after this I reserve the right to revise the quote and issue a new one, amending the price where I see fit.
5.7 The prices stated on our page are starting prices only, decorations will incur an additional cost. As will set up & delivery.
6. Returns & refunds
6.1 There will be no returns or refunds issued unless the product is faulty before it enters your hands.
6.2 When you have gone away with the cake, you have excepted it as it is.
6.3 We will not be responsible for damages where you have not followed the cake care guide.
7. Cancellations
7.1 Whereby you have to cancel your order, the booking deposit remains non-refundable.
7.2 The above statement applies regardless of how much notice you may give us.
8. The design of bespoke orders
8.1 We will make your order exactly as agreed between us when you made the booking.
8.2 We will not copy any design you sent us pictures of, we will merely use this for inspiration for copyright purposes.
8.3 We will never make 2 cakes exactly the same to keep the cakes bespoke to each individual customer.
8.4 In light of this, please note colours and placement of decorations from inspiration pictures will vary.
9. Liability for damage
9.1 We do not accept liability for a cake after it has been collected or delivered.
9.2 If a cake is damaged in transit after the customer has collected, we will not accept liability for the damage.
9.3 If a cake is moved after set up, we will not take any responsibility for the loss or damage.
9.4 If upon request, we have left your cake with someone else, we will not accept responsibility for loss or damage
10. Privacy Policy
10.1 We will not share any personal data with anyone, including photographs sent to us by you.
10.2 We will always ask permission before posting photographs you have sent to our social media platforms. Unless it is the re-share of a story you have tagged us in.
11. Online Market Products
11.1 Our website is only stocked with a vast amount of products once per calendar month (subject to our discretion).
11.2 We may periodically change the products available on our website, and we do not undertake to continue to supply any particular product or type of product.
11.3 The images of our products on our site are for illustrative purposes only. Your product and their packaging may vary slightly in colour, size and shape from these images (but will not vary in tastiness 🤪).
12. Prices
12.1 Our prices quoted for personalised orders on our website are starting prices only.
12.2 Any additional decoration to cakes, cupcakes, brownie slabs, giant cookies will be an extra charge.
12.3 We will, from time to time, change the prices quoted on our website, but this will not affect contracts that have previously come into force.
12.4 Where you are not collecting from our premises, you will have to pay a delivery or postal charge, which will be notified to you before the contract of sale comes into force.
13 Postal services
13.1 All of our parcels are sent via Royal Mail Tracked 24 hour service, if you want updates on where your parcel is, please ask us for your tracking number and you are more than welcome to see.
13.2 We, however, will not accept liability for the delay or loss of parcels when in Royal Mail’s possession.
13.3 On the occasion that a parcel is lost by Royal Mail, we are not liable and will not issue a refund.
14. Changes to our terms and conditions
14.1 We reserve the right to update, change or replace any part of our terms and conditions. At our discretion, anytime.
14.2 Your continued use of our services or of the website following any changes made amounts to your acceptance of these changes.
